E-COMMERCE TERMS AND CONDITIONS

These e-commerce conditions apply to purchases made by consumers on the Webshop, which are owned and operated by GERVIN , CVR no. 38694030, Lemmestrupvej 22, 8300 Odder (hereinafter referred to as “ GERVIN ”,“ We ”or“ us ”).
We recommend that you read the e-commerce conditions carefully before you shop at the Webshop. You will find the following points below:
You can order online 24 hours a day. We handle orders in the period 8.00 - 16.00 (GMT +1). Orders placed outside this period will be handled on the first following weekday.
When you place an order, we will send you an immediate receipt via email. Please note that this receipt is not an order confirmation and that we are not bound by the order at that time. Final agreement between you and GERVIN is only entered into when we per. email has confirmed to be bound by the order.
You are responsible for the accuracy of the customer information you enter as part of a purchase, as we do not subsequently validate or verify this information.
PRICES AND PAYMENT
All stated DKK prices are incl. Tax (25%). We reserve the right to change prices on the website with immediate effect. As a general rule, however, prices will be adjusted as of 1 February. The current price is the one that at the time of ordering is stated on the website next to a particular item.
Shipping costs for delivery in Denmark are included in the price. For delivery outside Denmark, please refer to our other sites.
We accept the credit cards shown at the bottom of the Webshop. When paying by credit card, payment is made at the same time as sending your invoice.
We treat your credit card information confidentially and we do not store your credit card information. Your credit card information is entered directly into a payment service, and we are therefore not aware of your credit card information. The above is for your safety. The webshop only stores the data necessary to be able to deduct the agreed purchase amount from your account when the item is sent to you.
All credit card payments are validated. GERVIN reserves the right to withhold an order if there is suspicion and fraud, money laundering or the like. The purchase price can only be refunded to the credit card used for the original purchase.
We encrypt all your card information with the so-called SSL (Security Socket Layer) protocol. This means that unauthorized persons cannot read your card number or other information during the transaction with DIBS, which handles payments for purchases made on PERNILLEGERVIN.COM. Also note that the page where you provide your card information looks different from the rest of our website. This is due to requirements from DIBS that the site must be secure and the information encrypted.
If your purchase entails delivery to an EU country other than Denmark, the rules on the free movement of goods apply, which means that you must pay Danish VAT, but not any local customs duties.
All orders are delivered with PostDanmark, GLS, FEDEX or DHL. The actual delivery time depends on the freight forwarder / delivery method chosen. You can expect to receive your order within 4-10 working days when we have the item in stock. As we can not guarantee local delivery conditions, we can not specify with certainty when the item will be delivered to the customer's / recipient's address.
If the individual order contains several items, we only send the order when all items are ready for delivery.
Please note that we cannot deliver to PO Box addresses.
RIGHT OF WITHDRAWAL
You have the right to cancel the purchase within 14 days of receiving the item. The right of withdrawal can be exercised without giving any specific reason by sending us a notice to this effect by ordinary letter, fax or e-mail. You can choose to use the standard cancellation form found at the bottom of this document, which is not a requirement.
NOTE: You can not exercise the right of withdrawal by simply refusing to receive the item or by failing to pick it up at the carrier.Please send the cancellation notice to the following address:
We recommend that you always state your order number in the cancellation notice to avoid errors and delays.
The right of withdrawal does not apply to items that have been adapted to your personal specifications.
If you send a notice of cancellation of the purchase, you must return the item to us at the same address without undue delay and no later than 14 days after you gave notice that you would regret the purchase. We may require documentation that the item has been shipped before the deadline.
If the item is shipped, it must be packed properly and please enclose a copy of the cancellation notice and / or indicate the order number on the package.
We recommend that international purchases be returned via PostDanmark, GLS, FEDEX or DHL to ensure that the goods are shipped safely and are insured during transport. However, you can also choose another secure shipping method. You pay for the return shipping yourself.
You are responsible for any damage that may occur during transport. Please also note that you must bear the costs associated with returning the item, unless we have delivered the item to you by mistake or if the item has been damaged or defective upon receipt. We do not have the opportunity to state the price for the return shipment in advance, as this i.a. depends on the weight of the item and the choice of carrier, etc.
Returned goods should be in good and undamaged condition. If returned goods show signs of damage or use, in addition to what is necessary to determine the nature of the goods, their properties and the way in which they work, you are liable for a deterioration in the value of the goods. We estimate a possible value based on a specific assessment of the returned item based on the following guidelines for impairment:
No signs of use and the item is in original packaging:
Minor signs of use of the item and / or original packaging:
Visible signs of use of the item and / or missing / damaged original packaging:
Visible damage to the item, such as scratches or non-removable stains:
Payment for the item will be refunded as soon as possible and in any case within 14 days of our receipt of your notice of withdrawal. However, we reserve the right to withhold the refund until we have received the item / items returned for inspection, or until you have submitted documentation that the item has been returned, whichever is earlier.
If you cancel the purchase in accordance with these e-commerce conditions, we will refund the purchase price less any impairment. Unless you have instructed us otherwise, we will make the refund using the same means of payment that you used to make the original transaction.
Your claim for refund does not include any fees for using credit cards or other means of payment that we have paid to the redeemer.

COMPLAINTS AND COMPLAINTS
We live off happy and satisfied customers. We therefore encourage you to contact us should you experience any problems with your purchased items.
In addition to the right of withdrawal, your general rights in the Sale of Goods Act apply to defective goods, delayed goods or goods that do not correspond to the description. You thus have a 24 month right to make a complaint, which means that if the delivered product is defective, you can:
Require a proportionate reduction in the purchase price or
Terminate the purchase agreement unless the defect is immaterial
The above naturally presupposes that your claim is justified and that the defect is not due to incorrect treatment or use or other damage to the item.
You have to give GERVIN notification of defective goods within a reasonable time after you have or should have discovered the defect. CHOICE OF LAW
These e-commerce conditions, and any purchase agreement regarding the purchase of goods from us, are subject to Danish law, with the exception of Danish choice of law rules and CISG.
We make reservations for typing errors, sold out items and force majeure, including delivery failures from our suppliers. Furthermore, GERVIN does not guarantee that the Webshop is always 100% up to date. GERVIN may at any time unilaterally change the content of the Webshop PERNILLEGERVIN.COM
GERVIN can not guarantee that colors and qualities are reproduced 100% correctly in the Webshop. The rendering depends on the color settings of the computer as well as the screen used. Furthermore, natural products such as gemstones will vary in color and luster. Minor color and gloss deviations are therefore not considered to be a defect within the meaning of the Purchase Act.
GERVIN always tries to provide correct and complete information in the Webshop. Despite this, errors can occur. If you have been charged an incorrect amount by mistake, you have the option of placing a new order with the correct price indication or canceling the purchase. GERVIN however, reserves the right to always cancel purchases before shipping your item, if we find that the purchase is based on erroneous information, including incorrect pricing. In these cases, you will be notified by e-mail. If we can not contact you, your order will be canceled automatically.
